1. Who These Terms Apply To

The Site is intended for businesses and professionals. By using it you confirm that you are at least 18 years old and, if you use it on behalf of a company or other organisation, that you have authority to bind that organisation to these Terms.

2. Using the Site

You may use the Site only for lawful purposes and in line with these Terms. You agree not to:

• attempt to gain unauthorised access to the Site, our servers, our admin area or any connected system, or to probe, scan or test their security without our written permission;
• introduce malware or any code intended to damage, disrupt or interfere with the Site or other users;
• use bots, scrapers or automated tools to copy the Site or its content at scale, or to overload the Site, except for ordinary search-engine indexing;
• submit false, misleading or unlawful content through our forms, or use the forms to send unsolicited promotions or spam;
• impersonate any person or organisation, or misrepresent your affiliation with X-istech;
• use the Site in a way that infringes the rights of others or violates any applicable law.

We may suspend or restrict access to the Site at any time, including to carry out maintenance or where we believe these Terms have been breached.

3. Intellectual Property

All content on the Site, including text, graphics, layout, logos, the X-istech name and mark, illustrations, case-study write-ups and the underlying code, is owned by X-istech or its licensors and is protected by copyright, trademark and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to view the Site and to print or download individual pages for your own internal, non-commercial reference. You may not otherwise copy, reproduce, modify, distribute, republish or create derivative works from the Site's content without our prior written consent.

Names and marks of other companies that appear on the Site, for example in case studies or technology lists, belong to their respective owners and are used only to identify them or the technologies we work with. Their appearance does not imply endorsement.

4. Information You Send Us

When you send us an enquiry, message or other material through the Site, you confirm that the information is accurate and that you have the right to share it. We will use it as described in our Privacy Policy.

Unless we have signed a separate non-disclosure agreement with you, please do not send us confidential, secret or sensitive information through the contact form or by email at the enquiry stage. Details of any project, and how confidential material is protected, are agreed in writing before work starts.

Ideas, suggestions or feedback you give us about the Site or our services may be used by us without obligation to you, although we will not publish your name or company without your permission.

5. Services and Client Engagements

Descriptions of services, engagement models (such as fixed-scope projects, dedicated teams and RPO staffing), technology capabilities, case studies, timelines and examples on the Site are provided for general information. They are not an offer, quote or guarantee, and they do not create a contract or a client relationship by themselves.

The scope, deliverables, timeline, fees, payment terms, ownership of work product, confidentiality, warranties and other terms of any project or staffing engagement are set out only in a separate written agreement or statement of work signed by X-istech and the client. If that agreement conflicts with these Terms, the signed agreement prevails for the engagement it covers.

6. Accuracy of Information

We take care to keep the Site accurate and up to date, but we do not guarantee that its content is complete, current or free of errors or omissions. Figures such as years in business, number of projects or team size are given as approximations at the time of publication and may change. Do not rely on the Site as professional, legal, technical or financial advice.

7. Third-Party Links and Services

The Site may contain links to third-party websites, tools and resources provided for convenience. We do not control them and are not responsible for their content, security, availability or privacy practices. Accessing them is at your own risk and subject to their own terms.

8. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all of its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, secure or error-free, or that it will be free of viruses or other harmful components.

Nothing in this section affects any warranties given to you in a signed client agreement, or any rights you have under law that cannot be excluded.

9. Limitation of Liability

To the fullest extent permitted by applicable law, X-istech and its directors, employees, contractors and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your access to or use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the Site will not exceed INR 10,000 (or the equivalent in your local currency). Liability under a signed client agreement is governed only by that agreement.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.

10. Indemnity

You agree to indemnify and hold X-istech harmless from any claims, losses, liabilities and reasonable expenses (including legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right, to the extent permitted by applicable law.

11. Privacy

Our Privacy Policy explains how we collect, use and protect personal information and forms part of these Terms. By using the Site you acknowledge that you have read it.

12. Reporting Infringement or Security Issues

If you believe content on the Site infringes your intellectual property rights, email info@x-istech.com with the details, including the location of the content and proof of your rights, and we will review it promptly.

If you discover a security vulnerability on the Site, please report it to info@x-istech.com and give us a reasonable time to fix it before disclosing it publicly. Please do not access, alter or delete data that is not yours while investigating.

13. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to its conflict-of-law rules. Subject to any mandatory consumer or local protections that apply to you, the courts at Pune, Maharashtra, India will have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site.

Before starting formal proceedings, we encourage you to contact us at info@x-istech.com so that we can try to resolve the matter informally. Disputes under a signed client agreement are resolved as that agreement provides.

14. Changes to the Site and These Terms

We may change, suspend or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; the latest version will always be posted on this page with its effective date. Your continued use of the Site after changes are posted means you accept the revised Terms.

15. General

If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and X-istech regarding use of the Site.
